Terms and Conditions of Sale
Sotheby’s acts as agent for The Krug Mindshare Charity Auction. Unless otherwise agreed, the sale of the Lots will result in contracts made between the individual minds chosen charities and the Buyer.
The Buyer will be the person with the highest bid accepted by the auctioneer.
The auctioneer has the right to refuse any bid and to advance the bidding at their absolute discretion, and in the case of error or dispute, to put up an item for bidding again.
Catalogue illustrations are for guidance only, neither Sotheby’s nor The Krug Mindshare Charity Auction are responsible for the correctness of any such statement nor for any other errors of description.
Traditionally at auctions buyers are responsible for satisfying themselves concerning the condition of goods. With The Krug Mindshare Charity Auction, buyers are responsible for knowing the personality and being aware of the particular minds skill sets.
If a prospective Buyer gives Sotheby’s instructions to bid on their behalf, by using the form distributed with the invitation. Sotheby’s shall use all reasonable efforts to do so, provided these instructions are received no later than 24 hours before the sale. Bids should be placed in pounds sterling. If Sotheby’s receives commission bids on a particular Lot for identical amounts, and at auction these bids are the highest bids for the Lot, it will be sold to the person whose bid was received first.
If prospective Buyers make arrangements with Sotheby’s not less than 24 hours before the sale, Sotheby’s shall make reasonable efforts to contact the bidders to enable them to participate by telephone, but in no circumstances will Sotheby’s or The Krug Mindshare Charity Auction be liable to any prospective Buyer as a result of failure to do so.
Subject to the auctioneers discretion, the striking of the hammer marks the acceptance of the highest bid and the conclusion of a contract for sale between The Krug Mindshare Charity Auction and the Buyer.
Following the sale, the Buyer must provide Krug Mindshare with his or her name and permanent address.
Where possible, all lots are to be paid for in full direct to the minds chosen charity.
The ‘collection’ of lots, will be arranged by Mission Media LTD, on behalf of The Krug Mindshare Charity Auction, and pending specific arrangements will be organised between the mind and the winning bidder at a mutually convenient time and location for a period of at least sixty minutes within a six month period of auction date.
These Conditions of Sale are subject to English law, which shall apply to their construction as well as to their effect. For Sotheby’s benefit, The Krug Mindshare Charity Auction and the Buyer submit to the exclusive jurisdiction of the English courts.
The mind has final refusal to decline his / her participation, should he / she deem the meeting to be a conflict of interest or compromising in anyway. In such case all monies will be fully refundable to the bidder.
